We offer 28 years of experience and knowledge providing environmental due diligence and due care services from the perspectives of consultants, regulators, and in-house industry representatives.  Based on a review of due diligence case law, industry self-assessments and surveys, and client outcomes for acquisitions completed 15 to 20 years ago, we've identified ways to significantly improve the process to consistently provide clients with long-term protection from environmental liabilities.

We employ the conceptual site model (CSM) approach to guide due diligence and due care for our client acquisitions and redevelopments.  It is not a new approach, but it is not widely practiced.  For simple and complicated cases, CSM is a powerful tool for understanding a site and its potential environmental liabilities.  It guides decision making and communicates technical information to non-technical audiences.  Landowner defenses to CERCLA liability require both All Appropriate Inquiries and due care; we see CSM as the goal for All Appropriate Inquiries and the basis for a meaningful due care plan.
